These General Terms and Conditions (hereinafter the »Terms«), posted on the https://theuntameddreamer.com/ website (hereinafter the »website«) under the »Terms of Use« section, govern your access to, usage of all content, Product and Services available at https://theuntameddreamer.com website (the “Service”) operated by The Untamed Dreamer, Aja Zorčič s.p. (“us”, “we”, or “our”). Your access to our services is subject to your acceptance, without modification, of all of the terms and conditions contained herein and all other operating rules and policies published and that may be published from time to time by us.

Please read the Agreement carefully before accessing or using our Services. By accessing or using any part of our Services, you agree to be bound by these Terms. If you do not agree to any part of the terms of the Agreement, then you may not access or use our Services.

Intellectual Property

The Agreement does not transfer from Us to you any of Ours or third party intellectual property, and all right, title, and interest in and to such property will remain (as between the parties) solely with The Untamed Dreamer, Aja Zorčič s.p. and its licensors, including the external platforms and associated websites (including, but not limited to, NES Health and Paperbell, hereinafter the »platforms«) that host some of the content referenced on this website, define the terms and conditions of use of the website and its contents, as well as the terms of use and purchase of services, courses and/or goods offered on this website and/or hosted on other hosting platforms.

The website and its contents, including the services, courses and/or goods hosted on other platforms, are operated and owned by Untamed Dreamer, poučevanje in svetovanje, Aja Zorčič s.p., Ulica Nade Čamernikove 10, 1000 Ljubljana, Slovenia (hereinafter the »Company« or the »Provider«). Special terms and conditions or contractual provisions may apply to individual segments, subpages or certain Users in addition to the Terms.

»Buyer«, »User« or »Client« in this Terms means every person that uses the website or purchases services, courses and/or goods from the Untamed Dreamer through the website or directly from the hosting platform. By visiting our website, purchasing and/or using our services, courses and/or goods, including free and gifted services, the User agrees to be bound by these Terms, including include all links with their components. These Terms apply to all Users of the site, including without limitation users who are browsers, vendors, customers, merchants, and/or contributors of content.

Any new features or tools which are added to the website or the hosting platforms shall also be subject to these Terms of Service. We reserve the right to update, change or replace any part of these Terms of Service by posting updates and/or changes to our website and the associated platforms. It is a responsibility of the User to periodically review these Terms for changes. The User’s continued use of or access to the website and the hosting platforms following the posting of any changes constitutes acceptance of those changes.

All contents of this website (i.e. all information available on the website and the services, courses and goods offered on the website or the hosting platforms, hereinafter the »Content«) are copyrighted and owned by the Untamed Dreamer. All intellectual property rights related to the Content are in the sole ownership of the Provider and may not be used without explicit written consent of the Provider.

Third-Party Services

In using the Services, you may use third-party services, products, software, embeds, or applications developed by a third party (“Third-Party Services”).

If you use any Third Party Services, you understand that:

Any use of a Third Party Service is at your own risk, and we shall not be responsible or liable to anyone for Third Party websites or Services.

You acknowledge and agree that We shall not be responsible or liable for any damage or loss caused or alleged to be caused by or in connection with the use of any such content, goods or services available on or through any such websites or services.

Whenever the Services and Content of the company is provided through associated platforms (including, but not limited to, NES Health and Paperbell), the User will also be required to comply with the Terms and Conditions of each platform. 

Please read these Terms of Service carefully before accessing or using our website and related Content. By accessing or using any part of the website or our related services, courses and/or goods, you agree to be bound by these Terms of Service. If you do not agree to all the terms and conditions of this agreement, you may not access the website or use any services. If these Terms of Service are considered an offer, acceptance is expressly limited to these Terms of Service. A breach or violation of any of the Terms will result in an immediate termination of your Services.

Content and Services

A variety of different pieces of content, digital products and services is offered by the Untamed Dreamer, including but not limited to online digital courses, e-books, and coaching packages. The content of online courses is hosted within the website. Paperbell platform is used for handling all the bookings and the payments for the 1-on-1 coaching packages.

Digital Content and the Right of Withdrawal for EU Consumers

According to the law of the European Union, Users who are consumers residents in the EU have the right to withdraw from a contract for services and digital content purchased online within 15 days from the effective date of the contract for the services or the digital content without the obligation to state the reason for the withdrawal, yet the desire to withdraw should be clearly communicated to the Provider in written form (the contact email to which such statement should be sent is aja@theuntameddreamer.com). Untamed Dreamer extends this right to all its users, regardless of their geographical region.

However, this right is not applicable for anyone, including EU residents, in the cases where a) the service has been fully performed or b) where the performance or access to the digital content has already begun, with the User’s prior consent and acknowledged in the form of a signed contract, that they would lose their right of withdrawal in these two cases. More details on refunds can be found in the Refund Policy section.

The Untamed Dreamer reserves the right to refuse service to anyone for any reason at any time, and to limit the sales of the products or Services to any person, geographic region or jurisdiction. This right may be exercised on a case-by-case basis.

Nature of the Services

All Services provided by the Untamed Dreamer are for educational and entertainment purposes only. The information and communications transmitted during Services not be considered as or ever substitute appropriate medical, psychiatric, legal, financial or advice, nor should they substitute the advice and/or care from a certified professional. Please seek the advice of a trained medical doctor about any health concerns.

The Untamed Dreamer does not warrant that the quality of any products, Services, information, or other material purchased or obtained by the User will meet his/her expectations, or that any errors in the Service will be corrected. There are no guaranteed results for using the Services, and the experience of others you may be aware of and/or whatever prior results you might have experienced yourself from using the Services do not guarantee a comparable outcome. You release the Untamed Dreamer of any and all liability resulting from the use or misuse of the Content and information obtained from the Company for any reason.

Delivery and Expiration of the Services

The delivery method for different Services depends on the product the User has purchased, and is always clearly defined in the description of the product available to the User before making the purchase.

Generally, the User that purchases any of the coaching package has a maximum of 12 months available to book their purchases appointments with the coach. After this period of time, the appointments can no longer be booked and are deemed to have expired, regardless of how many of the purchased appointments the client has actually used. The exception to this is the ongoing coaching, where the client is paying a monthly subscription.

Modifications to the Service and Prices

The Untamed Dreamer reserves the right to modify or discontinue any of the Services (or any part or content thereof) and/or to to limit the quantities of any products or Services that we offered without notice at any time. In this case, those that have already purchased the Service will have the right to completed it as per the conditions applicable at the time of purchase.

Furthermore, the prices for the products and packages are subject to change without notice at any time.

The Untamed Dreamer shall not be liable to the User or to any third-party for any modification, price change, suspension or discontinuance of the Service.

Prohibited Use of Content and Services

The Content and Services provided by the Untamed Dreamer may not be used for any illegal or unauthorized purposes, nor may any laws (including but not limited to copyright laws) be violated during the use of the Content and Services.

In addition to other prohibitions as set forth in the Terms of Service, the User is prohibited from using the website or its content for a) any unlawful purposes; b) to solicit others to perform or participate in any unlawful acts; c) to violate any international, federal, provincial or state regulations, rules, laws, or local ordinances; d) to infringe upon or violate our intellectual property rights or the intellectual property rights of others; e) to harass, abuse, insult, harm, defame, slander, disparage, intimidate, or discriminate based on gender, sexual orientation, religion, ethnicity, race, age, national origin, or disability; f) to submit false or misleading information; g) to upload or transmit viruses or any other type of malicious code that will or may be used in any way that will affect the functionality or operation of the Service or of any related website, other websites, or the Internet; h) to collect or track the personal information of others; i) to spam, phish, pharm, pretext, spider, crawl, or scrape; j) for any obscene or immoral purpose; or k) to interfere with or circumvent the security features of the Service or any related website, other websites, or the Internet.

Untamed Dreamer reserves the right to terminate the use of the Service or any related website for any User violating any of the prohibited uses.

Intellectual Property

All Content, including but not limited to downloads, recordings, products, logos, service names, designs and slogans on the website and hosting platforms are the property of Untamed Dreamer and are provided to the User based on his/her agreement not to reproduce, publicly share , modify, adapt, prepare derivative works based on, perform, display, publish, distribute, transmit, broadcast, sell, license, or otherwise exploit under any circumstances, except with written permission from the Untamed Dreamer. Failure to adhere to these Terms may result in legal action to enforce these Terms and our intellectual property rights.

The User is solely responsible for his/her own safety while using downloaded audio and video recordings and similar products. They should not be used while driving or operating heavy machinery.

By accepting these Terms, the User agrees not to reproduce, duplicate, copy, sell, resell or exploit any portion of the Service, use of the Service, or access to the Service or any contact on the website through which the Service is provided, without express written permission by the Untamed Dreamer.

Third-Party Links

Certain content, products and services available via the Untamed Dreamer website and the associated platforms may include links to materials on third-party websites that are not affiliated with the company. The Untamed Dreamer is not responsible for examining or evaluating the content or accuracy of these websites and will not warrant nor have any liability in relation to, or responsibility for any third-party materials or websites, or for any other materials, products, or services of third-parties.

The Untamed Dreamer is not liable for any harm or damages related to the purchase or use of goods, services, resources, content, or any other transactions made in connection with any third-party website. It is up to the User to carefully review and understand the third-party’s policies and practices before engaging in any transaction. Complaints, claims, concerns, or questions regarding third-party products should be directed to the third-party directly.

Scope of the Relationship

The scope of all the Content and Services provided to the User by the Untamed Dreamer is specifically defined in the description of every product. By purchasing a product and agreeing to these Terms, the client is deemed to understand and accept precisely what he/she is buying.

In general terms, purchasing an online course gives the User access to the contents of the course, of which some may be downloadable and some may not, depending on the nature of the courses. Short digital courses may be accessed immediately upon purchase. For some, all content is immediately available for the User to work through as he/she sees fit. In other, generally those of a longer, pre-defined duration, the content is gradually released on a weekly basis. Some of the longer courses may include memberships in private support groups or periodical group live coaching, as indicated in the course description. Purchasing an online course does NOT include direct access to the course instructor via any means of communication, nor any sort of individual treatment; the latter is only available should the User decide to separately purchase and book individual coaching sessions.

The scope of individual coaching packages in clearly defined in the description of each individual coaching package. By agreeing to these Terms, the User confirms that he/she understands exactly what the chosen package entails. Generally, the coaching packages are limited to a predetermined number of video call sessions of varying lengths via which the coaching is being administered and a predetermined number of bioenergetic scans. Some packages may include additional benefits, as stated in the description.

In addition to the predetermined number of 1-on-1 sessions, the User, while actively enrolled in one of the coaching programs, may also reach out to the coach with additional questions on time-sensitive matters via email no more than once per week. It is otherwise advised that the questions be saved by the User and presented to the coach during life sessions. Should email contact be deemed necessary by the User, the messages are to be addressed to aja@theuntameddreamer.com. No other form of direct contact with the coach is included in the coaching packages. The recording of the coaching calls are not provided to the User by the coach, unless specifically requested and agreed upon in writing by both parties.

For individual coaching services and bioenergetic assessment’s, the scope of the relationship is additionally defined in the Contract the User signs electronically prior to the commencement of the services. By signing the contract, the User reaffirms his/her understanding and agreeing to the the below stated Service Disclaimer.

Payment Policy

For all Services and Content purchased and/or provided under these Terms of Service, Untamed Dreamer shall retain the right to determine, in its sole discretion, the method, terms, and timing of acceptable payment.

General payment terms

For all Services and Coods purchased and/or provided under these Terms, the Useer shall tender to the Untamed Dreamer the full and complete purchase price and any applicable sales tax and shipping costs before the Untamed Dreamer shall be required to provide the Services and/or ship the goods. Should the Untamed Dreamer ever deliver goods and/or Services to the User before payment is tendered, User shall deliver the full and complete purchase price and any applicable sales tax and shipping costs as soon as possible, otherwise buyer will be in breach of contract.

Accuracy of Billing and Account Information

By purchasing the Services and Content form the Untamed Dreamer and accepting these Term, the User agrees to provide current, complete and accurate purchase and account information for all purchases made through the website or associated platforms. The User agrees to promptly update his/her account and other information, including your email address and credit card numbers and expiration dates, so as to enable the Untamed Dreamer to complete the transactions and contact the User as needed.

Payment Options

Purchases of Services and Content are made either on the Untamed Dreamer website or through one of the platforms on which the Untamed Dreamer Services and Content are hosted. Payments can be made by credit card through either Paypal or Stripe, depending on the platform and the Service or piece of Content being purchased.

The Untamed Dreamer and its associated platforms accept payment by credit card, debit card, PayPal and/or Stripe and other forms of payment that we make available from time to time.

Currency and Conversion

All payments will be paid in or converted to EUR currency, and your payment provider may charge a conversion fee.

Taxes and Other Expenses

User shall pay all taxes and third-party expenses imposed on, in connection with, or measured by the transactions contemplated by these Terms.

If Untamed Dreamer is required to collect or pay any taxes in connection with the User’s purchase of any Services or Content through the website or associated platforms, such taxes will be charged to you at the time of each purchase. Additionally, if required by law, the User is responsible for reporting and paying certain taxes in connection with the purchase and use of any Services or Content provided through the website or the associated platforms.

Subscriptions

Monthly subscription is available for the ongoing coaching programs, where the number of appointments is not determined in advance (pay as you go style). In this case, the client pays a monthly subscription fee indicated in the package description; the credit card provided to complete the purchase is automatically charged every month. The client is able to book all their appointments as soon as the purchase is made, limited to the number of appointments the package includes per month, and a maximum of 12 months in advance. Any unused subscription appointments cannot be transferred to the following month.

Subscriptions continue indefinitely until they’re cancelled by the client (in their package page) or provider. As soon as the subscription is cancelled, clients can no longer book remaining appointments, and any future appointments that have already been booked are deleted. It is therefore recommended that the User waits until the very end of their subscription period before cancelling, in order to use all their appointments, otherwise he/she will end up losing them.

If the recurring payment fails for whatever reason, the client will be notified and will have a grace period during which the payment can be made. In opposite case, the subscription will be terminated by the provider.

Payment Plans

For certain longer coaching engagements, payment plans are available, meaning that the price of the coaching package is broken down into a predetermined number of smaller amounts and paid off periodically over time, as indicated in the product description. When the User opts for a payment plan, the price of the product is higher than when the whole amount is paid up front.

In this case, the User will only be able to use a proportionate part of their booked Services in between instalments; in practical terms, if the total sum is broken down into three payments, the User will only be able to use a third of the services before the second instalment.

Similarly to the subscription option, the User’s credit card will be automatically charged when the next payment is due, nothing needs to be re-submitted or confirmed. Unlike the subscription, the User cannot self-cancel payment plans, and as per the refund policy, the payment plan is not eligible for a refund beyond the 15-day refund period. If, for whatever reason, the User wishes to cancel the Service midway through the payment plan, before using all the Services, he/she should contact the Untamed Dreamer directly at aja@theuntameddreamer.com to discuss their options. In such case, any potential refund shall be solely at the discretion of Untamed Dreamer and dealt with on a case-by-case basis.

Late payment policy

As all other payments have to be done up front, late payment is only possible in case of payment plans and subscription. In these cases, of the User’s credit card fails for whatever reason when the payment is due, the User will be notified and given a 5-day grace period to update their payment information or secure the necessary funds. During this time, several retries will be made. If the payment is not successful after five days, the User will lose access to the Service and all future booked appointments will be canceled, while the unused ones will not be eligible for a refund.

Refund and Cancellation Policy

Untamed Dreamer makes no guarantee as to the outcome and/or results of any Service and/or consultation provided to Users, whether obtained via direct sale, through our website, affiliate websites or associated platforms, or by any other method, and adheres to a general no refund policy, meaning that all sales are considered to be final, with a few exceptions that are always handled on a case-by-case basis:

A 15-day refund policy is in place, meaning that all users can request a refund within 15 days of their purchase date, under the condition that Service the User purchased has not yet been fully performed, or that the performance or access to the digital content has not yet begun. In practice, the User can ask for a refund for a coaching session he has purchased, but not used, or a course that he/she as never accessed, within 15 days of the purchase date. Further clarifications:

1. If the User purchased a coaching package and used less that the number of sessions included in that package, he may still request a refund of the proportional part of the sessions he/she has left (minus a 10% administrative fee), all within 15 days.
2. If the user purchased a course in which the content is released periodically, on a weekly basis, he/she is eligible for a full refund (minus a 10% administrative fee) within 15 days.
3. If the User purchased a mini course where all content is released at once, and the User has already accessed the course material, he/she is no longer eligible for a refund.
4. If the User purchased an individual coaching session, and he/she already used/had the session, he/she is no longer eligible for a refund.

Beyond the 15-day period, all sales are considered to be final, unless specifically stated otherwise on the website or associated platforms, that is, unless the User purchases a Product that comes with a money-back guarantee, which will be clearly indicated in the cases where it might apply, as it is not a general Policy of the Untamed Dreamer to offer such guarantee. Any such refund shall be solely at the discretion of Untamed Dreamer and dealt with on a case-by-case basis.

The User is therefore advised to take advantage of the free services available in order to determine whether the Untamed Dreamer is the right fit for his/her needs, wishes and desires.

No chargeback policy

The User is required to inquire about any chargeback request and past payments made directly with the Company at aja@theuntameddreamer.com before initiating a payment dispute with either their bank, credit card company, PayPal or Stripe.  

Purchase and Working Procedure

The purchase process and working processes are different depending on whether the User is purchasing coaching sessions, online courses or downloading an e-book.

Coaching Sessions

Coaching sessions are offered in a variety of different packages, with different lengths and numbers of session within each package. Once the User chooses the package that best serves his/her needs, he/she will first be prompted to book the appointments through the calendar, then sign a Contract/Disclaimer, and then taken to the payment page, where the purchase will be completed, thus confirming the appointment.

Scheduling

The User can book an available time slot in the calendar by choosing the date and time that best serves him/her. The system will automatically block out the time in the calendar as per the specified length of appointment, and a confirmation email will be sent to the client upon completion of the purchase.

Number and Length of the Appointments

The length and the number of appointments included in each package is clearly specified in the description of each individual package. Neither the number nor the length of appointments can ever be exceeded, so as not to infringe on the working schedule of the Untamed Dreamer. In practical terms, if the length of a session is limited to 60 minutes, the session will last no more than 60 minutes.

Time Between the Appointments

For the bioenergetic assessment packages, the optimum time in between appointments is 3-4 weeks, because that is generally how long it takes for the changes to take root at the bioenergetic level. However, the User is free to decide how to schedule and use the number of sessions in the package.

As for ongoing coaching subscriptions, the User is also free to decide how to spread out the number of appointments available each month, though it is advisable to try and spready them out evenly.

Expiration Policy

All appointments within a certain package must be booked the latest within one year of the purchase date. Any remaining appointments that have not yet been scheduled one year from the purchase date will expire and no longer be available to the User, nor eligible for any sort of recompensating or a refund.

Rescheduling, Cancellations, No-Shows

The User will receive rescheduling links in the email and calendar appointment he/she will get after completing the purchase. He/she can go to https://app.paperbell.com/client to modify or cancel their appointments. All appointments have to be canceled or rescheduled a minimum of 24 in advance, otherwise they will be treated as no-shows.

No-shows are non-redeemable and non-refundable. Meaning, if the User does not show up for a scheduled appointment, the appointment will be considered having been used, and the User will not be entitled to another one to make it up, or to receive any refund for the missed appointment.

Untamed Dreamer may, but is not obliged to, in its sole discretion, allow the User to use amount paid as credit towards a future service, or grant an additional appointment in cases where the cancelation or a no-show was a result of an emergency.

Contract

After scheduling, the User will be given an additional Contract/Disclaimer to sign electronically before proceeding to the payment and thus confirming the Service.

Payment

Where applicable, the client will be given an option to pay the full amount in advance, or to split it up into several instalments. The Payment can be made either by credit card or via Stripe. All other information regarding the payment can be found in the Payment Policy section.

Free NES Account

Once the package is paid for and thus confirmed, the User will be able to download the instructions on how to create a free account at the NES Health Portal, which will not only allow him/her to easily do a voice scan, which is a prerequisite for a bioenergetic assessment, but also give him/her access to loads of free bioenergetic materials as well as an exclusive bioenergetic shop.

Intake Form

Once signed up, an Intake Form will be sent to the User via the portal, in order to provide the coach with additional information regarding their current state.

Voice Scan

The User will also receive instructions on how to do a bioenergetic voice scan, which will automatically be sent to the coach upon completion. The voice scan should ideally be done at least 24 hours before the scheduled coaching session.

Coaching Sessions

The coaching sessions are conducted via Zoom video calls. The User will automatically receive the link invitation upon booking, as well as a reminder one day and 30 minutes before the session.

Follow-Up Form

The User will receive a Follow-Up Form 28 days after each voice scan, in order to assess the changes and progress during that time. If he/she had not done so already, that would also be a good time to do another scan and book their next appointment.

NES Health Bioenergetic Shop

When signing up for coaching sessions with Untamed Dreamer, the User will be given access to an exclusive Bioenergetic shop, through which he/she will be able to purchase a number of different bioenergetic remedies and devices. This shop and its contents does not belong to the Untamed Dreamer, though the company does make a small commission on every purchase made by the User. All questions regarding the shop, purchases, shipping, etc., should therefore be directed at Nes Health, not the Untamed Dreamer.

Client Duties

The Users are expected to show up to their sessions on time, submitting the voice scan prior to every session where that is applicable, and do the preparation work such as any readings, reflections or “homework” assigned by the coach during the previous session.

Online Courses

There are two types of courses offered by the Untamed Dreamer; so-called Mini Courses and longer courses called Journeys. AT this time, neither are available for purchase.

User Data and Information

Personal Data Processing

Personal data is processed according to the Privacy Policy.

Account Security

If the User creates an online user account, he/she is responsible for maintaining the security of the username and password, and shall be solely responsible for all activities that occur on his/her account. Untamed Dreamer encourages the use of “strong” passwords, i.e. passwords that use a combination of upper and lower case letters, numbers and symbols.

User Comments, Feedback and Other Submissions

The User agrees that any creative ideas, suggestions, proposals, plans, comments, or other materials he/she sends to the Untamed Dreamer by posting online, by email, by postal mail, or in any other manner, may be published, distributed, translated or otherwise used by the company at any time, without restriction or editing.

By submitting a comment, testimonial, or review to Untamed Dreamer, the User agrees, gives permission for, and hereby grants any necessary license to the Untamed Dreamer to publish and/or reproduce any part of the testimonial on the website, associated platforms, printed media or on any other affiliated or third-party website, edited or unedited.

The Untamed Dreamer is under no obligation to copy, and otherwise use in any medium any comments that you forward to us. We are and shall be under no obligation to maintain any such comments in confidence, to pay compensation for any comments or to respond to them.

The Untamed Dreamer may, but has no obligation to, monitor, edit or remove content it determines, in its sole discretion, to be unlawful, offensive, threatening, libelous, defamatory, pornographic, obscene or otherwise objectionable or in violation of any party’s intellectual property or these Terms.

The User agrees that his/her comments will not violate any right of any third-party, including copyright, trademark, privacy, personality or other personal or proprietary right, contain libelous or otherwise unlawful, abusive or obscene material, or contain any computer virus or other malware that could in any way affect the operation of the Service or any related website. The User may not use a false e-mail address, pretend to be someone else. The User is solely responsible for any comments you make and their accuracy.

Exclusion of liability

The Untamed Dreamer does not guarantee or warrant that your use of its Service will be uninterrupted, timely, secure or error-free. While the company does intend for its Services to be regularly available, they may on occasion be interrupted, suspended or discontinued, including, without limitation, for possible maintenance or upgrades, for emergency repairs, or due to failure of telecommunications links and/or equipment. The Company will not be liable to you for any such modification, suspension, or discontinuation of the services.

Further, the Company will not be liable for any damages or costs incurred to the User due to the cessation, non-functioning or other issues with the functioning of the website of the associated platforms and affiliated websites.

The company does not ensure the accuracy, reliability, completeness and correctness of the information or the results obtained from the use of the Service, nor does it assume liability for damages which the consumer might suffer due to reliance on posted content. The use of the website and any Service and/or products and Content obtained through the website or associated platforms is at the User’s own risk and provided on an “as is” basis. The internet, including this website, may be subject to breaches of security, therefore any information that you submit through this website may not be forever secure.

The User agrees that from time to time, Untamed Dreamer may remove the Service for indefinite periods of time or cancel the Service at any time, without previous notice to the User. In case of any technical problems on the website, the company reserves the right to cancel all submitted orders or purchased Services which were affected by the technical problem, and does not assume any liability towards the User form this title. In case the User is directly affected by the cancelation, he/she will be contacted in the shortest time possible and informed about the further steps/measures to be taken.

The Untamed Dreamer is not liable for damages which may occur to the User’s hardware, software or any other equipment due to using its website or associated platforms. The User is responsible for ensuring adequate computer protection (antivirus etc.) before accessing and using the website or associated platforms.

The User also needs to ensure adequate security and privacy for information used to sign in on the website (e-mail address, password). The Company is not liable to Users for damages that might result from unauthorized disclosure or usage of their registration information.

Errors, Inaccuracies and Omissions

Occasionally, the information on the website or associated platforms may contain typographical errors, inaccuracies or omissions that may relate to product descriptions, pricing, promotions, offers, product shipping charges, transit times and availability. We reserve the right to correct any errors, inaccuracies or omissions, and to change or update information or cancel orders if any information in the Service or on any related website is inaccurate at any time without prior notice (including after the User has submitted their order).

The Company undertakes no obligation to update, amend or clarify information in the Service or on any related website, including without limitation, pricing information, except as required by law. No specified update or refresh date applied in the Service or on any related website, should be taken to indicate that all information in the Service or on any related website has been modified or updated.

Disclaimer of Warranties

The User expressly agrees that the use of, or the inability to use, the Untamed Dreamer Service is at his/her sole risk. The Service, Content and products delivered to the User are provided ‘as is’ and ‘as available’ for his/her use, without any representation, warranties or conditions of any kind, either express or implied, including all implied warranties or conditions of merchantability, merchantable quality, fitness for a particular purpose, durability, title, and non-infringement. The Company does not warrant that the Services will be error-free or uninterrupted; that defects will be corrected; or that the services or the server is free from any harmful components, including, without limitation, viruses, nor that the use of the Service by the User is in compliance with the laws of any jurisdiction, including any international laws or treaties. The Company does not warrant that information transmitted by the User in connection with the service will be successfully, accurately or securely transmitted, and specifically disclaims any responsibility or liability to any person or entity for any loss, damage (whether actual, consequential, punitive or otherwise), injury, claim, liability or other cause of any kind or character based upon or resulting from any use of a Service, Content or product purchased or downloaded through the website or its associated platforms.

Service Disclaimer

By agreeing to these Terms, the User confirms to understand that the Services provided by the Untamed Dreamer represent a non-medical approach to wellness. By engaging in the Services, the user understands that the coach or instructor may provide guidance on healthy lifestyle choices; that these are not medical services; and that this is not an emergency or mental counseling service.

The User understands that the coach/instructor is NOT a licensed physician and that is only acting as a consultant and facilitator. Further, the User takes full responsibility for any health protocol he/she chooses to pursue, including the extent to which he/she does or does not follow such protocols, and agrees to hold the Untamed Dreamer and the instructor or coach operating in the name of the Company harmless in regards to his/her health experiences.

The User understands that the instructor or coach makes NO ATTEMPT to diagnose, prescribe, prevent, or treat any medical disease, but only to guide the User in supporting the body to improve and maintain itself. The User also understands that consultations are based in part on the information that they provide about themselves, and therefore certifies that all information provided about his/her health conditions and lifestyle (or about those he/she represents) is accurate to the best of his/her knowledge.

The User understands that the Untamed Dreamer will make every effort to safeguard his/her personal information, but that it may be shared as necessary in order to comply with the law. In this sense, members of the Untamed Dreamer team and as well as web service providers that receive the information digitally do in some cases have access to the information provided by the User.

The User acknowledges that the Untamed Dreamer hereby encourages him/her to visit his/her physician for medical emergencies; acute viral, bacterial, or other physical/biochemical diseases; and any other condition that requires medical attention.

Finally, the User confirms to be at least 18 years of age (or to be the parent or legal guardian of the client receiving the Services in case the client is underage) and fully competent to make his/her own health care decisions (or to make such decisions on behalf of the underage client).

Final provisions

Indemnification

The User agrees to indemnify, defend and hold harmless Untamed Dreamer and its subsidiaries, affiliates, partners, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers, interns and employees, from any claim or demand, including reasonable attorneys’ fees, made by any third-party due to or arising out of your breach of these Terms of Service or the documents they incorporate by reference, or the User’s violation of any law or the rights of a third-party.

Severability

In the event that any provision of these Terms of Service is determined to be unlawful, void or unenforceable, regardless of the reason for its invalidity, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law. The unenforceable portion shall be deemed to be severed from these Terms of Service, and such determination shall not affect the validity and enforceability of any other remaining provisions.

If any provisions of these Terms contradict the provisions set forth in individual contract concluded between the Userr and Company or provisions of any special terms and conditions, the contractual provisions or provisions of special terms and conditions shall prevail.

Termination

These Terms of Service are effective unless and until terminated by either the User or Untamed Dreamer. The User may terminate these Terms of Service at any time by notifying the Company that he/she no longer wishes to use its Services, or when he/she ceases to use its website and services provided elsewhere.

If, in the sole judgment the Company, the User fails, or the Company suspects that he/she has failed, to comply with any term or provision of these Terms, the Company may also terminate this agreement at anytime without notice, and the User will remain liable for all amounts due up to and including the date of termination; and/or accordingly may deny the User’s access to our Services (or any part thereof).

Complaint Resolution

All complaints shall be addressed directly to the Untamed Dreamer at aja@theuntameddreamer.com, and every attempt will be made to resolve the complaint promptly and amicably.

Governing law and jurisdiction

Company shall use its best endeavors to resolve any disputes amicably. Therefore, any activity covered by these Terms of Service shall be resolved through mediation before resolving to binding arbitration. Should this not be possible, the competent court in Ljubljana, Slovenia shall have jurisdiction to settle such disputes.

The Provider does not recognize any out-of-court consumer dispute resolution provider (ADR for consumers) as competent for the resolution of a consumer dispute that may be brought by a consumer in accordance with the Act on Out-of-Court Consumer Dispute Resolution (Official Gazette of the Republic of Slovenia, No. 81/15).
